Virginia Underage Possession
Underage possession of alcohol is a serious offense in Virginia. In fact it is a class 1 criminal misdemeanor, which carries the potential for up to 1 year in jail.
Because alcohol is widely available, it may come into the possession of those who are under the age of 21, such as high school or college students.
Although, the charge is serious and would result in a criminal conviction that would never go away, the law does allow those charged with underage possession to enter into first offender program. The first offender program is not automatically given and so it is best to have an experienced attorney to walk you through the process and to maximum the opportunity of the court allowing for first offender.
